Terms of Service

Standard payment terms require a 30% deposit upon order confirmation and 70% balance payment before shipment. All payments must be made via wire transfer or other agreed-upon methods.

Payment terms may be adjusted for established long-term partners upon mutual agreement. Late payments may result in production delays or order cancellation.

All products are manufactured according to international children's apparel quality standards including GOTS, OEKO-TEX Standard 100, OCS, CPC, and BSCI requirements where applicable.

Our quality control process includes fabric testing, in-line inspection, and final inspection before shipment. An acceptable quality level (AQL) of 2.5 is standard unless otherwise specified.

Customers are responsible for providing clear specifications and approving samples before bulk production. Manufacturing tolerances apply to measurements, color matching, and fabric shrinkage as per industry standards.

Customers retain full ownership of their original designs, artwork, logos, and branding materials. Kids Wear Factory agrees to maintain confidentiality and will not reproduce or share customer designs with third parties.

Customers are responsible for ensuring that all provided materials do not infringe on third-party intellectual property rights. Kids Wear Factory assumes no liability for intellectual property violations originating from customer-supplied content.

Shipping arrangements can be made through Kids Wear Factory or by the customer's designated freight forwarder. Shipping costs are the responsibility of the customer unless otherwise agreed upon.

Delivery dates are estimates and may be affected by factors beyond our control. Kids Wear Factory is not liable for shipping delays caused by customs, freight carriers, or force majeure events.

Risk of loss and title pass to the customer upon shipment from our facility (FOB terms) unless alternative Incoterms are agreed upon in writing.

Due to the custom nature of our manufacturing services, returns and refunds are only available in cases of manufacturing defects or material non-conformance to approved specifications.

Claims must be submitted within 7 days of receiving the shipment, accompanied by photographic evidence and detailed descriptions. Approved claims may result in replacement production or partial refund at our discretion.

Order cancellations are not accepted once production has begun. Deposit payments are non-refundable after sample approval.

Kids Wear Factory's liability is limited to the total value of the specific order in question. We are not liable for indirect, incidental, or consequential damages including lost profits, business interruption, or reputational harm.

Customers are responsible for compliance with all applicable laws and regulations in their target markets, including product safety standards, labeling requirements, and import regulations.
